Constitution Campaign

In 2023, the Registrar completed a campaign to ensure that there is a valid wind-up clause in all CHP constitutions, whether under the National Law or the Local Scheme, in accordance with section 15(2)(c) of the National Law.

To be valid, the wind-up clause should ensure that any community housing assets on the winding up of the company are transferred to another registered CHP or a Housing Agency in the jurisdiction. A valid wind-up clause ensures that government funding and assets are protected.

Wind-up clauses will continue to be monitored during a CHP’s scheduled assessment to ensure ongoing compliance with the National Law.
