As the independent regulatory authority, the Registrar is responsible for both promoting a culture of compliance and detecting and addressing non-compliance at the earliest opportunity.
Wherever possible, the Registrar will respond to areas for service improvement or non-compliance by identifying the action the provider should take to improve performance and bring the organisation to compliance. The provider will be given the opportunity to take responsibility for remedying its performance. Where non-compliance is not remedied by the provider, or where the non-compliance is serious in nature, the Housing Act 2001 (NSW) gives the Registrar the power, amongst other things, to issue the provider with a notice.
The Registrar’s aim in issuing notices is to have the provider bring itself to compliance and to protect the integrity of the community housing sector. The Housing Act also gives the Registrar the power, under section 67C, to publish notices on the public register. Those notices are:
- Notice of Intent to Cancel Registration
- Notice of Determination to Cancel Registration

Notices of intent to cancel registration
Where a registered community housing provider has not addressed matters in a notice of non-compliance, or where the non-compliance is serious and requires urgent action, the Registrar may issue to the provider a notice of intent to cancel registration within a specified period. If the provider does not remedy the non-compliance matters detailed in the notice within the specified period, the provider’s registration will be cancelled. The period given to a provider to remedy non-compliance will vary on a case-by case basis and will depend on the nature and consequences of the non-compliance. However, the specified period must be at least 14 days. If a notice of non-compliance has previously been issued, the specified period in the notice of intent to cancel registration is in addition to the specified period in the notice of non-compliance. The specified period may be extended by the Registrar at the request of the community housing provider concerned, if the Registrar is satisfied that there are good reasons for extending the period.
When a notice of intent to cancel registration is issued, the registered community housing provider is provided an opportunity to address the matters in respect of which the notice has been issued. The notice may require the registered community housing provider to appoint a special adviser and/or to address the matters raised and to satisfy the Registrar that its registration should not be cancelled.
Accommodation Network Pty Ltd
A delegate of the Registrar has issued a notice of intent to cancel the registration of Accommodation Network Pty Ltd as a community housing provider under the Housing Act 2001 (NSW) unless it appoints special advisers to assist it to address the matters of non-compliance and reports to the Registrar on those matters and satisfies the Registrar that its registration should not be cancelled.
Subsequently, a delegate of the Registrar has issued a decision to extend the period for responding to the Notice of Intent to Cancel Registration of Accommodation Network Pty Ltd.
St George Women's Housing Inc
A delegate of the Registrar has issued a notice of intent to cancel the registration of St George Women's Housing Inc as a community housing provider under the Housing Act 2001 (NSW) unless it addresses matters of non-compliance and reports to the Registrar on those matters and satisfies the Registrar that its registration should not be cancelled.

Community Outreach Ministries
A delegate of the Registrar has issued a further notice of intent to cancel the registration of Community Outreach Ministries Inc as a community housing provider under the Housing Act 2001 (NSW) unless it addresses matters of non-compliance and reports to the Registrar on those matters and satisfies the Registrar that its registration should not be cancelled.
Notices of determination to cancel registration
The Registrar must cancel the registration of a registered community housing provider if the Registrar is satisfied that a notice of intent to cancel registration has been issued and the registered community housing provider has failed, within the period specified in the notice, to satisfy the Registrar that its registration should not be cancelled or to appoint a special adviser.
Housing NSW is not to give assistance to a community housing provider unless the community housing provider is registered and, as far as reasonably practicable, Housing NSW is to withdraw assistance from a community housing provider that ceases to be registered. Where a community housing provider’s registration is to be cancelled, the Registrar works closely with Housing NSW to support the smooth transfer of assistance and management of risks.
Presbyterian Social Services
A delegate of the Registrar has issued a notice of determination to cancel the registration of Presbyterian Social Services as a community housing provider under the Housing Act 2001 (NSW). Registration will be cancelled on 19 October 2012.
Tamworth Youth Care Inc
A delegate of the Registrar has issued a notice of determination to cancel the registration of Tamworth Youth Care Inc as a community housing provider under the Housing Act 2001 (NSW). Registration will be cancelled on 27 August 2012.
The Benevolent Society
The Registrar has issued a notice of determination to cancel the registration of The Benevolent Society as a community housing provider under the Housing Act 2001 (NSW). Registration will be cancelled on 6 March 2012.
Tanderra Women’s and Children’s Refuge Ltd
The Registrar has issued a notice of determination to cancel the registration of Tanderra Women’s and Children’s Refuge Ltd as a community housing provider under the Housing Act 2001 (NSW). Registration is cancelled effective 1 March 2012.
Campbell Page Ltd
A delegate of the Registrar has issued a notice of determination to cancel the registration of Campbell Page Ltd as a community housing provider under the Housing Act 2001 (NSW). Registration will be cancelled on 1 October 2011.
Central Tablelands Housing Association Inc
The Registrar has issued a notice of determination to cancel the registration of Central Tablelands Housing Association Limited as a community housing provider under the Housing Act 2001 (NSW). Registration is cancelled effective 1 September 2011.
B Miles Women’s Housing Scheme Inc
The Registrar has issued a notice of determination to cancel the registration of B Miles Women’s Housing Scheme Inc as a community housing provider under the Housing Act 2001 (NSW). Registration is cancelled effective 19 August 2011.
